1. Introduction

1.1 These Terms and Conditions (“Terms”) govern Your use of the AIBIMTool AI building design platform at aibimtool.com (the “Platform”), operated by MeltFlex s.r.o., a company registered in the Slovak Republic (“AIBIMTool”, “We”, “Us”, “Our”).

1.2 By creating an account or using the Platform, You agree to be bound by these Terms. If You do not agree, please do not use the Platform.

1.3 We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

1.4 Nothing in these Terms affects Your statutory rights under applicable consumer protection laws, including EU consumer protection legislation.

2. About the Platform

2.1 AIBIMTool is an AI-powered building design platform. You describe a building, a brief or a site in words, and an AI agent turns it into a program, massing and an editable BIM model of walls, slabs, roofs, doors, windows and spaces, which You can view in 3D in the browser and export as an IFC file for Revit, ArchiCAD, Rhino and other BIM software.

2.2 The Platform is provided as a Software-as-a-Service (SaaS). Access to features is based on Your plan. The Platform is under active development; We may change, add or remove features at any time.

3. Account Registration

3.1 To use the workspace, You must create an account by signing in with Google. You are responsible for keeping access to that Google account secure.

3.2 You must provide accurate and complete information when creating Your account. You agree to update Your information if it changes.

3.3 You are responsible for all activities that occur under Your account. Notify Us immediately at info@aibimtool.com if You suspect unauthorized access to Your account.

3.4 You must be at least 16 years old to create an account and use the Platform.

4. Plans and Payments

4.1 The Platform offers a free plan and may offer paid plans or credit packs. Details of available plans, features and pricing are shown on the Platform before You buy.

4.2 Paid subscriptions are billed on a recurring basis (monthly or annually, depending on Your chosen plan). By subscribing, You authorize Us to charge Your payment method on each billing date.

4.3 All payments are processed securely by Stripe. We do not store Your credit card or payment details on our servers.

4.4 Prices are displayed in the currency detected based on Your location. All prices include applicable taxes unless stated otherwise.

4.5 We reserve the right to change prices with 30 days' notice. Price changes will not affect Your current billing period.

5. Free Plan and Credits

5.1 Generating and editing models with the AI agent uses credits. The free plan includes a limited number of credits, provided at Our discretion; the free allowance may be changed or discontinued at any time.

5.2 Credits are non-transferable and have no cash value. Unused plan and pack credits stay in Your balance and do not expire while Your account is open.

6. Cancellation and Refunds

6.1 You may cancel Your subscription at any time under Manage billing on the subscription page. Cancellation takes effect at the end of Your current billing period. You will retain access to paid features until then.

6.2 Refunds, including the 14-day right of withdrawal for consumers in the European Union, are described in our Refund Policy, which forms part of these Terms.

7. User Content

7.1 You retain ownership of all briefs, prompts, site information and other content You provide to the Platform (“User Content”).

7.2 By providing User Content, You grant AIBIMTool a non-exclusive, worldwide, royalty-free license to process, store and display it solely for the purpose of providing the Platform's services to You.

7.3 You represent and warrant that You have the right to provide all User Content and that it does not infringe any third party's rights.

7.4 You must not provide content that is illegal, harmful, defamatory, or violates any person's privacy or intellectual property rights.

7.5 We reserve the right to remove any User Content that violates these Terms.

8. AI-Generated Models

8.1 The Platform uses artificial intelligence to generate building programs, massing, BIM models, IFC files, areas, quantities, renders and related output (“AI Content”).

8.2 AI Content is generated as a starting point for Your design work. It is not a substitute for the work of a qualified architect or engineer, and must be independently checked before it is used for planning applications, permits, tenders, construction or any safety-critical purpose. AIBIMTool does not check AI Content against building codes, zoning rules or structural requirements on Your behalf.

8.3 While We strive for accuracy, AI Content may contain errors, inaccuracies or inconsistencies. Dimensions, areas and quantities are approximations until verified by You.

8.4 You may use AI Content generated from Your User Content for personal, commercial or professional purposes (e.g., design studies, client presentations, further development in Your own BIM software), subject to these Terms.

8.5 AIBIMTool does not claim ownership of AI Content generated from Your User Content. We do not use Your prompts, briefs or models to train, fine-tune or otherwise improve AI models, and We do not provide them to third parties for that purpose. We use aggregated usage statistics — such as how often a model is exported or how long a generation takes — to improve the service; these contain no User Content.

9. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to circumvent plan limits or credit systems
• Use automated tools to access the Platform (bots, scrapers)
• Provide content that is harmful, offensive, or violates third-party rights
• Attempt to access other users' accounts, projects or data
• Interfere with the Platform's security or infrastructure, including the environment that builds models
• Resell or redistribute the Platform's services without authorization

Violation of these rules may result in immediate account suspension or termination.

10. Intellectual Property

10.1 All intellectual property rights in the Platform, including its design, code, modelling engine, branding and content (excluding User Content and AI Content generated from Your User Content), belong to AIBIMTool or our licensors.

10.2 You may not copy, reproduce, reverse-engineer, decompile, or commercially exploit any part of the Platform without Our prior written permission.

10.3 The AIBIMTool name, logo, and branding are trademarks of MeltFlex s.r.o. You may not use them without Our written consent.

11. Limitation of Liability

11.1 To the maximum extent permitted by law, AIBIMTool's total liability to You for any claims arising from or related to these Terms or the Platform shall not exceed the total amount You paid to Us in the 12 months preceding the claim.

11.2 We shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or business opportunities, or for costs arising from designs, permits or construction based on AI Content.

11.3 We do not guarantee that the Platform will be available at all times or free from errors. We may perform maintenance that temporarily limits availability.

11.4 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be legally excluded.

12. Account Termination

12.1 You may delete Your account at any time by contacting us at info@aibimtool.com. Upon deletion, Your data will be removed in accordance with our Privacy Policy.

12.2 We may suspend or terminate Your account if You breach these Terms, with or without notice depending on the severity of the breach.

13. Force Majeure

We shall not be liable for any failure to perform Our obligations where such failure results from circumstances beyond Our reasonable control, including natural disasters, war, government actions, pandemic, infrastructure failures, or third-party service outages.

14. Governing Law and Disputes

14.1 These Terms are governed by the laws of the Slovak Republic.

14.2 If You are a consumer in the European Union, You benefit from any mandatory provisions of the consumer protection laws of Your country of residence.

14.3 If We cannot resolve a complaint together, a consumer may turn to an alternative dispute resolution body; in the Slovak Republic this is the Slovak Trade Inspection (Slovenská obchodná inšpekcia, soi.sk).
